Missouri Joins 44 Other States - Data Breach Notification Law Effective by End of Month

Missouri is the latest state to join the other 44 in the nation with its passing of a data breach notification law. House Bill 62 will be effective as of August 28th, 2009. The regulation requires anyone (person or business) who handles sensitive personal information to provide notification if there is unauthorized access (security breach) to the system where the personal data resides.

Under 407.1500 of Missouri's House Bill 62, personal information includes first name/initial and last name in combination of any of the following: social security number, driver’s license number, financial account number, credit or debit card number with security/access code. In addition, the statute extended the definition of "personal information" to also include any unique electronic identifier, medical information and health insurance information.

Violation of this law may also result in civil penalties up to $150,000 per breach of the security of the system.
